Privacy Statement for KYOCERA Connected App

We are KYOCERA Document Solutions (U.K.) Limited, located at Eldon Court, 75-77 London Road, Reading, Berkshire, RG1 5BS, United Kingdom, hereinafter referred to as KYOCERA, “we” or “us”.

This Privacy Statement applies to the app KYOCERA Connected (hereinafter referred to as “App”) that KYOCERA offers via the Google Play Store and the Apple App Store which you – as the user – use when creating a user account in the App.

 

In this Statement, we will explain in detail the following:

  • Why and for what purposes and on what legal basis we are processing your personal data
  • With whom we share your personal data and to which countries your personal data is sent to
  • For how long we keep your personal data
  • What your legal rights are concerning us processing your personal data
  • How you can contact us and other important information

 

I. PURPOSES AND LEGAL BASIS OF DATA PROCESSING

Provision of the App

KYOCERA processes the personal data of users only to the extent necessary to provide a functioning App and related services in compliance with the EU 2016/679 General Data Protection Regulation (GDPR).

Before using the App you must provide KYOCERA with your personal data in order to create and activate the user account. KYOCERA processes your name, email address, company name and password in order to create, activate, provide, maintain and administer your account. The requested personal data are mandatory to use the App. In case you provide KYOCERA with further information –such as your phone number – you do this voluntarily. KYOCERA only uses your phone number in case you submit a request for KYOCERA to call you.

Regarding the above mentioned processing purposes KYOCERA has a legitimate interest to process your personal data, Article 6(1)(f) GDPR. After carefully balancing the users’ rights and freedoms on informational self-determination and KYOCERA’s interest of processing personal data, we conclude that in this present case KYOCERA’s interests prevail and that the users’ rights and freedoms are adequately protected. As mentioned in recital 48 of GDPR, the European Legislator has recognized a Data Controller’s business interest to market its own products and services as a legitimate interest. Further, you have the right to object to processing of your personal (for further details see IV and V). However, your objection to rocess your personal data may cause that you are not able to use the App.

 

II. RECIPIENTS OF PERSONAL DATA

KYOCERA has engaged third party service providers for hosting and maintenance and support services. These third party service providers are based in the United Kingdom and Ireland. KYOCERA concluded Data Processing Agreements with these service providers in
order to ensure an adequate level of protection for your personal data.

 

III. RETENTION PERIOD

KYOCERA shall keep your personal data related to your user account as long as you have an active user account. You may at any time request us to delete your account. In that instance, we shall erase your user account within 24 hours after your request. Your personal data stored in backup files will be automatically deleted 35 days after its creation. Additionally, KYOCERA may store your personal data where KYOCERA is so required by applicable laws.

 

IV. YOUR RIGHTS

In relation to your personal data you have the following rights:

 

ACCESS

You have the right to be informed on whether KYOCERA processes your personal data or not, and, in case KYOCERA processes your personal information you may ask for further information regarding the processing.

 

RECTIFICATION

You have the right to have your personal data rectified or completed by KYOCERA without undue delay. If you have set up a user account with KYOCERA, you have the possibility to rectify or complete your personal data yourself.

 

RIGHT TO BE FORGOTTEN

You have the right to have your personal data erased by KYOCERA without undue delay. This right is limited to specific grounds, for example if you have withdrawn your consent or if you object to the processing and there are no overriding legitimate grounds for KYOCERA to maintain the processing

 

RESTRICTION OF PROCESSING

You have the right to request that KYOCERA restricts the processing of your personal data based on specific grounds. These are (1) the time for KYOCERA to verify the accuracy of your personal data on your request; (2) instead of erasure of unlawful processing, you request restriction of use instead; (3) you need personal data in legal proceedings; or (4) while KYOCERA verifies whether its legitimate grounds override your objection to the processing.

 

RIGHT TO OBJECT

You have the right to object at any time to the processing of your personal data if such processing is based on KYOCERA’s legitimate interests. KYOCERA ceases to process your personal data based on your objection, unless KYOCERA demonstrates compelling legitimate grounds overriding your interests, rights and freedoms or if KYOCERA needs your personal data in legal proceedings.

 

DATA PORTABILITY

KYOCERA is required to inform you of your right to receive your personal data from us so that you can transmit that personal data to another service provider related to your user account.
 

CONSENT WITHDRAWAL

If you have supplied KYOCERA with your personal data based on your consent, you have the right to withdraw such consent at any time with future effect by sending us an email to privacy@duk.kyocera.com. We shall then permanently remove your personal data from our database.


LODGING A COMPLAINT

You have the right to lodge a complaint with your local Data Protection Supervisory Authority about our processing of your personal data.
